1. Acceptance of Terms 
By accessing, booking, purchasing, or receiving services from Aunt Jane’s LLC, you agree to be legally bound by these Terms and Conditions. If you do not agree, do not use our website or services.
 

2. Description of Services

 Aunt Jane’s LLC provides temporary jagua gel tattoo services in the United States of America. Jagua gel is a plant based topical stain derived from the fruit of Genipa Americana. Our formula is made from fresh fruit juice, organic lavender oil, and natural thickeners. The product is 100 percent plant based and food grade. Jagua stains the outer layer of the skin and typically lasts 1 to 3 weeks depending on skin type, placement, and aftercare.

 

Authenticity and Nature of Product

Our Jagua gel is the industry standard formulation derived from Amazonian Genipa americana fruit. The stain develops naturally through oxidation and darkens over 24 to 48 hours.

Because Jagua is a natural botanical product:

• Color results may vary
• Development time may vary
• Final shade and appearance cannot be guaranteed

 

3. Age Requirement

 Services are available to individuals age 6 and older. Clients under 18 must have a parent or legal guardian present to provide consent. The parent or guardian assumes full responsibility for the minor. We are not responsible for accidents, misuse, skin reactions, allergic reactions, or stained items.
 

4. Allergy Warning

This product contains fruit based ingredients. Do not use if you have known allergies to berries, citrus, tropical fruits, lavender, or plant based products.Clients are responsible for disclosing any known allergies, skin sensitivities, or medical conditions prior to application. A patch test may be requested but is not guaranteed to prevent allergic reactions.

 

5. Assumption of Risk

By receiving a jagua tattoo, you voluntarily assume all risks associated with the application of a plant based topical stain. You acknowledge that risks may include but are not limited to:

• Skin irritation • Redness • Itching • Allergic reaction • Staining beyond intended design • Dissatisfaction with outcome

You agree that you are solely responsible for monitoring your skin’s reaction and seeking medical attention if necessary.

 

6. Waiver and Release of Liability

To the fullest extent permitted by law, you release, waive, discharge, and hold harmless Aunt Jane’s LLC, it’s owners, employees, contractors, and affiliates from any and all claims, demands, damages, liabilities, actions, or causes of action arising out of or related to:

• Allergic or adverse skin reactions • Improper aftercare • Misuse of the product • Accidental staining of clothing or property
• Dissatisfaction with the design, size, placement, or final appearance • Any injury or medical condition allegedly resulting from the service
 

This release applies to all claims, whether known or unknown, foreseeable or unforeseeable.

7. Limitation of Liability

To the maximum extent permitted by law, Aunt Jane’s LLC it’s owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from the purchase or use of our products or services. In any and all circumstances, total liability shall not exceed the amount paid for the service.

 

8. No Refund Policy- ALL SALES ARE FINAL.

Due to the nature of body art and hygiene standards:
• No refunds • No exchanges • No partial refunds
• No refunds for dissatisfaction with color, placement, size, fading, or development outcome

By purchasing our services, you acknowledge and agree to this strict no refund policy.

9. Indemnification

You agree to indemnify and defend Aunt Jane’s LLC from any claims, losses, damages, liabilities, costs, or legal fees arising from:

• Your violation of these Terms • Your misuse of the product • Your negligence • Any claim brought by a third party related to your use of our services
 

10. Governing Law

These Terms are governed by the laws of the State of Florida and the United States of America, without regard to conflict of law principles.

 

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Attorneys’ Fees; Costs of Enforcement

In the event of any dispute, claim, demand, arbitration, or legal proceeding arising out of or relating to the services, products, application, or use of jagua gel provided by Aunt Jane's LLC, Client will pay all attorneys’ fees, court costs, arbitration fees, expert witness fees, and other expenses incurred in connection with such dispute, in addition to any other relief awarded. Client expressly agrees that if Client initiates any claim, lawsuit, arbitration, chargeback, or other proceeding against Aunt Jane's LLC, Client shall be responsible for all attorneys’ fees, litigation expenses, and related costs incurred by Aunt Jane's LLC in defending such action. As well as, incurring disruption fees at $100 per encounter, and $500 per day.

This provision shall survive the completion of services and shall apply to any claim whether sounding in contract, tort, statutory violation, or otherwise, to the fullest extent permitted by law.

 

Binding Arbitration and No Class Actions​

Any dispute arising out of or relating to the services provided shall be resolved exclusively through binding arbitration conducted in Lee County, Florida, in accordance with the rules of the American Arbitration Association. Client waives the right to a jury trial and agrees not to participate in any class action or representative proceeding.

DISCLAIMER AND WAIVER OF LIABILITY

By receiving a Jagua gel temporary tattoo from Aunt Jane’s LLC, I acknowledge and agree:
 

1. I understand this is a temporary botanical stain derived from Genipa americana fruit.
    

2. I understand the product contains fruit based ingredients and organic lavender oil.
    

3. I confirm I do not have known allergies to berries, citrus, tropical fruits, lavender, or similar plant based substances.
    

4. I understand skin reactions are possible even with natural products.
    

5. I voluntarily assume all risks associated with application.
    

6. I release and waive all claims against Aunt Jane’s LLC, it’s owners, employees, contractors, and affiliates for any adverse reaction, injury, dissatisfaction, or damages.
    

7. I understand there are absolutely no refunds under any circumstance.
    

8. I agree not to initiate or participate in any lawsuit, claim, or legal proceeding against Aunt Jane’s LLC relating to this service, except where prohibited by law.
    

9. I acknowledge that this agreement is binding upon me, my heirs, assigns, and representatives.
    

By purchasing or receiving services, I confirm I have read, understood, and agreed to these terms.
